Robert E. Rohde

Practice/Experience:  

Mr. Rohde has practiced law since 1982. He is the former chair of the Intellectual Property Practice Group of Bogle & Gates PLLC. 

Mr. Rohde’s practice focuses on complex commercial litigation with an emphasis on intellectual property litigation (patents, trade secrets, trademarks and copyrights). He has tried many cases, both jury and non-jury, in federal and state courts. Mr. Rohde has also handled numerous alternative dispute resolution cases. 

Mr. Rohde is an accomplished appellate lawyer. He has argued numerous times before the Federal Circuit Court of Appeals, the Ninth Circuit Court of Appeals and the Washington Court of Appeals. Mr. Rohde has prevailed on six of his last nine appeals. 

Mr. Rohde has been recognized by his peers as a Washington State Super Lawyer in Washington Law and Politics each year since 2002. 

Representative Cases:  

Microsoft v. Timeline – Lead counsel for Timeline in multimillion-dollar licensing dispute with Microsoft. Prevailed on appeal. Case reversed and remanded for entry of judgment in favor of Timeline. 

TeraBeam v. Dominion Communications - Lead counsel in patent case involving $100 million claim for infringement of laser communications network patent. Obtained summary judgment of non-infringement. 

Bell Helicopter Textron v. IAC, Ltd. Lead counsel for Bell Helicopter in case alleging misappropriation of Bell’s trade secrets. Preliminary injunction entered after multi-day evidentiary hearing. Injunction affirmed on appeal. 

Forte Technologies v. Virtual I-O – Lead counsel for Virtual I-O in a patent case involving a head tracking system for virtual reality headsets. Defeated motion for preliminary injunction. Purchased and revived abandoned patent application creating new prior art which forced plaintiff to settle case on extremely favorable terms. 

Wade Cook v. Anthony Robbins - Lead counsel for Wade Cook in copyright infringement trial against the nationally known motivational speaker. Obtained plaintiff's verdict which was upheld on appeal. 

Lamb Weston v. McCain - Lead counsel for Lamb Weston in trade secrets trial. Obtained preliminary injunction, damages and attorneys fees. 

US Tel v. Sprint - Lead counsel for Sprint in a telecommunications rate trial. Obtained favorable judgment after trial for Sprint. 

Van Ackeren v. KCTS - Lead counsel for KCTS in trial of copyright and misrepresentation case involving the underwriting and production of KCTS’s highly successful “Over Washington” program. Obtained defense verdict. 

Patent Value Programs:  

Timeline Patent Program – Representation of Timeline in program to realize the value of its database software patent portfolio. Counseled client in conceiving and executing program. Program resulted in payment of more than $20 million in licensing fees from Microsoft, Oracle and others. 

CRS, LLC – Put together group of investors to purchase patent portfolio and realize approximately $13 million in value through licensing and sale of patents.
